In addition to our workmanship guarantee, many of the products we use, such as Latham pool liners and Hayward equipment, come with manufacturer warranties. We will assist you in understanding and accessing any applicable manufacturer warranties to ensure your peace of mind.

II. PoolBusters Custom Product Order No Refund Policy
1. Custom Product Orders:
a. PoolBusters offers custom-made products tailored to your specifications and requirements. These custom products include but are not limited to vinyl swimming pool liners, covers, and accessories.
2. Order Placement:
a. Upon placing a custom product order with PoolBusters, you acknowledge and agree to the terms outlined in this No Refund Policy.
b. Orders may be placed through our website, over the phone, or in person at our showroom.
3. Payments and Deposit:
a. A deposit is required to initiate the custom product order process. The deposit amount will be specified at the time of order placement.
b. Payment of the deposit signifies your commitment to proceed with the order and your acceptance of the terms of this No Refund Policy.
4. Card on file requirement
To ensure a smooth and secure service experience, PoolBusters requires a valid credit card to be kept on file prior to the start of services. This applies to both residential and commercial clients, though additional billing terms may apply for commercial accounts.
We store this card securely using PCI-compliant systems, which meet industry standards for safeguarding your payment information. Your card will not be charged without prior notice, except in the following cases:

Automated billing for recurring services or subscription plans you’ve agreed to

Late payment resolution, if an invoice remains unpaid after the due date

Cancellation fees, if applicable under our cancellation policy

Damage recovery, where costs are clearly documented and communicated
By keeping a card on file, you help us maintain efficient scheduling, reduce administrative delays, and provide timely service. We will always notify you in advance of any charges outside of scheduled service billing.
5. No Refunds Policy:
a. All custom product orders are non-refundable once the order has been confirmed and production has commenced.
b. No refunds will be provided for deposits or payments made towards custom product orders, regardless of circumstances, after a period of 48 hours has elapsed from the time of order placement.
c. In the event of a refund request, customers must contact the warranty department of the respective manufacturers, including Latham, Hibury, and Linerwerx, to initiate the refund process. Refunds will be subject to the terms and conditions of the manufacturer's warranty policy.
6. Changes and Cancellations:
a. Any changes to custom product orders must be requested within 48 hours of order placement and are subject to approval by PoolBusters.
b. Requests for order cancellations must be made within 48 hours of order placement. After this period, orders cannot be canceled, and deposits will not be refunded.
c. PoolBusters reserves the right to assess additional fees or charges for changes made to custom product orders after the initial 48-hour period.
d. If the Client wishes to cancel an ongoing service, the Client acknowledges and agrees that any portion of the service completed up to the date of cancellation will be billed accordingly. Charges will be calculated based on the actual work performed, including labor, materials, and any related costs incurred. These charges are non-refundable and must be paid in accordance with the payment terms outlined in this agreement.
e. All custom orders are final and non-cancellable once confirmed. Due to the personalized nature of custom work, cancellations will not be accepted after the order has been placed, except with the express written consent of PoolBusters. PoolBusters reserves the right to approve or deny any such cancellation request at its sole discretion. If a cancellation is approved, the Client may be subject to applicable restocking fees and/or costs incurred up to the date of cancellation.
7. Quality Assurance:
a. PoolBusters is committed to delivering high-quality custom products that meet your specifications and expectations. We strive to ensure accuracy, craftsmanship, and customer satisfaction with every order.
b. In the unlikely event of any defects or issues with your custom product order, please contact PoolBusters promptly to discuss resolution options.
8. Acknowledgement:
a. By placing a custom product order with PoolBusters, you acknowledge that you have read, understood, and agreed to the terms of this No Refund Policy.
9. Modifications to Policy:
a. PoolBusters reserves the right to modify, update, or amend this No Refund Policy at any time without prior notice. Any changes will be effective immediately upon posting on our website or other communication channels.
10. Governing Law:
a. This No Refund Policy shall be governed by and construed in accordance with the laws of Ontario, Canada.
11. Chargeback Policy:
a. Clients are prohibited from initiating chargebacks or reversals of charges on their credit card for payments made towards custom product orders with PoolBusters.
b. In the event that a client initiates a chargeback or reversal of charges without valid cause or authorization, PoolBusters reserves the right to take appropriate legal action to recover the disputed funds.
c. Clients who initiate unauthorized chargebacks or reversals of charges will be held liable for any associated fees or costs incurred by PoolBusters in recovering the disputed funds.
d. PoolBusters reserves the right to assess a chargeback recovery fee to cover administrative and processing costs incurred as a result of unauthorized chargebacks or reversals initiated by the client.
e. Clients are responsible for contacting the manufacturer directly to address any concerns or disputes regarding their custom product orders before initiating chargebacks or reversals of charges.
f. By placing a custom product order with PoolBusters, clients acknowledge and agree to adhere to the terms of this Chargeback Policy and accept liability for any unauthorized chargebacks or reversals initiated in violation of this policy.
12. Water Policy
Homeowners bear sole financial responsibility for all expenses associated with pool water, including procurement and delivery costs.
This encompasses charges from municipal billing or third-party water hauling services.
PoolBusters explicitly disclaims any financial liabilities concerning pool water, disassociating itself from any payment obligations or disputes arising from water-related expenditures.
This indemnification extends to cover discrepancies in water quantity, delivery charges, or billing issues.
By engaging PoolBusters for pool services, homeowners implicitly agree to adhere to and abide by these stipulations regarding pool water costs.
PoolBusters will not be involved in any disputes or negotiations related to water billing or delivery charges.
PoolBusters reserves the right to revise or update this policy at its discretion.
This policy is immediately enforceable for all PoolBusters clients and engagements.
This revised version emphasizes the homeowner's exclusive financial responsibility for all aspects of pool water, from procurement to delivery costs, while maintaining PoolBusters' non-involvement in related disputes or negotiations.
III. Collateral Damage & Pre-Existing Conditions
At PoolBusters, we take great care in servicing your pool equipment. However, due to the nature of mechanical systems and environmental wear, some components—particularly older, brittle, or corroded parts—may break, crack, or fail during inspection, maintenance, or repair.
As such, PoolBusters is not responsible for collateral damage resulting from the failure of aging, fragile, or pre-worn equipment parts during the normal course of our work. This includes, but is not limited to:

Cracked PVC fittings, unions, or valves

Corroded pump lids or filter housings

Rusted or seized fasteners and clamps
-
Deteriorated O-rings, gaskets, or seals
We always strive to notify clients in advance when we identify visibly compromised components. However, some failures may occur unexpectedly despite reasonable handling and best practices.
Repairs or replacements needed due to the failure of such parts will be the responsibility of the property owner.
IV.Unpaid Balances & Collections

A 3% monthly interest charge will be applied to all overdue balances starting 15 days after the invoice date.

After 45 days, we reserve the right to file a contractor’s lien against the property where services were performed and/or products installed.

After 60 days, any warranty on unpaid work or products may be suspended or voided.

After 90 days, all unpaid balances are transferred to SJP Paralegal for collection. We also reserve the right to sell or assign unpaid debts to a licensed third-party collection agency. Clients are responsible for all legal and administrative recovery costs, including paralegal fees, legal fees, court costs, interest, and lien fees.
If a new issue arises during or after completion of work that is outside the original scope of the quote, we will not proceed with further service or remediation unless the balance for all completed work and installed products has been paid in full. Clients may not withhold payment for completed and delivered work due to unrelated or newly discovered issues.
V. Liner Installations Disclaimer
Scope of Work:
Poolbusters is committed to delivering high-quality liner installations for your pool. Our service includes the installation of a new liner, tailored to the specifications of your pool.
a. Disclaimer of Liability:
Concrete Bottom Condition:
Poolbusters will perform an initial assessment of the pool's concrete bottom. However, it is important to understand that our responsibility does not extend to the underlying condition of the concrete bottom. We assume no liability for any issues arising from pre-existing conditions of the concrete, including but not limited to cracks, uneven surfaces, or structural weaknesses.
Patching of Concrete Bottom:
If minor repairs or patches to the concrete bottom are necessary, they will be performed at an additional cost. These repairs will be billed based on time and materials. Please note that any patching work is considered temporary and is not covered by our warranty. Poolbusters does not provide a warranty or guarantee for the durability or effectiveness of any patches made to the concrete bottom.
Inspection and Repair:
Our installation service does not include comprehensive repair or reinforcement of the concrete bottom. Any issues identified during installation that could affect the liner’s performance or longevity will be documented and reported to you. It is the responsibility of the pool owner to address these issues before or during the liner installation process.
Custom Projects:
In cases where complex measurements are required to finalize and approve drawings for production, additional charges will apply. These charges will be based on the number of site visits necessary to complete accurate measurements and obtain final approval.
Furthermore, all projects requiring complex measurements will result in an extended installation timeline. Clients should anticipate an additional 2 to 3 weeks added to the standard installation schedule to accommodate the precision and coordination involved in this process.
Warranty on Concrete Bottoms:
Poolbusters can only provide a warranty for the concrete bottom if we are contracted to replace the entire concrete surface. If we are not replacing the entire concrete surface, or if only minor patches are made, any issues with the concrete bottom will not be covered under our warranty.
Limitation of Liability:
Poolbusters shall not be held liable for any damage or defects in the liner, or any other damages, that result from an inadequate or compromised concrete bottom. This includes any indirect or consequential damages that may arise due to issues with the concrete surface.
Customer Acknowledgment:
By proceeding with the liner installation, you acknowledge and accept that Poolbusters is not responsible for any issues related to the concrete bottom of your pool unless we are contracted to replace the entire concrete surface. Additionally, any minor patching performed will be billed separately and is not covered under our warranty. It is recommended that you have a qualified professional evaluate and address any concrete-related concerns prior to the installation.
VI. Recovery Fees & Legal Costs

Interest Charges – 3% per month (36% annually) on overdue balances.

Lien Filing Fee – $600 administrative fee for initiating and managing a contractor’s lien on the serviced property, plus actual filing and discharge costs.

Paralegal File Initiation Fee – $500 flat fee once the file is transferred to SJP Paralegal after 90 days delinquency.

Ongoing Legal Fees – Billed at actual cost for further legal action, including any paralegal/lawyer time, court filings, or legal correspondence, to the extent permitted by law.

Collection Agency Fee – If the debt is assigned to a third-party collection agency, the client is responsible for any commission or service fees charged by the agency, typically ranging from 25–35% of the amount owing.

Administrative Charges – $50 per written demand letter or formal notice issued after 45 days overdue.

Court Fees – All filing fees, process serving costs, and enforcement-related expenses will be added to the total claim.
